Behavioral healthcare is a rapidly growing field. As more funding has become available, many new programs have opened, existing centers have expanded, and access to care has increased. Concurrent with this growth, however, have been ethical concerns as programs rapidly transform. Owners and operators are concerned about competing with organizations that engage in patient brokering, misrepresentation in marketing, overreliance on drug testing, and inaccurate or fraudulent financial and outcomes data. Reputable providers face ethical dilemmas as they balance growth and investment opportunities on one hand with providing effective and efficient patient care on the other. Tom Garofola

Tom Garofola is Retreat’s Chief Marketing Officer. Tom has been with Retreat since its planning stages. Tom holds a Master’s Degree in Human Services (MHS) and is a Licensed Clinical Alcohol and Drug Counselor (LCADC). He began his career as an addictions counselor. In 2001, he was asked to head up the planning efforts for the Criminal and Juvenile Justice Subcommittee of New Jersey Governor’s Council on Alcohol & Drug Abuse (GCADA). Currently, Tom serves as the President for the New Jersey Chapter of Employee Assistance Professionals Association (NJEAPA). In his private time, Tom volunteers as the leader of a family support group and serves as the assistant director of a youth basketball league.
Cynthia A. Haines
Principal, Post & Schell, PC

Cynthia A. Haines is a Principal in the Firm's Health Care Practice Group. She counsels and represents clients on state and federal health law and related regulatory and compliance issues, including: surveys; licensure; Medicare/Medicaid; compliance; audits; accreditation; payment matters; HIPAA security and privacy compliance; insurer compliance with federal, state and local laws, regulations and policies; and voluntary disclosures.
Her clients include a variety of institutional health care providers, such as hospitals and health systems, as well as post-acute care clients, including: continuing care retirement communities (CCRCs); long-term care facilities; personal care homes; assisted living providers; home and community based providers; LIFE programs; pharmacies enrolled in the PACE Program; hospices; rehabilitation providers, and adult day care centers.
Since joining Post and Schell, Cindy has been assisting clients with legal issues and strategic counseling involving technology, healthcare information systems, data privacy matters, healthcare regulatory compliance, and e-commerce. In particular, she has worked on the development, acquisition, negotiation, transfer and licensing of complex information systems; Health Information Exchanges (HIEs); networks and software; acquisition and implementation of Electronic Health Records (EHRs); data privacy protection, including Health Insurance Portability and Accountability Act of 1996 (HIPAA) compliance; Internet and technology-use policies; consulting/services agreements; and corporate, contractual and intellectual property matters.
Prior to joining Post & Schell, Ms. Haines spent 22 years as an attorney with the Commonwealth of Pennsylvania (PA). Ms. Haines was counsel for review and negotiation of Department of Aging IT contracts and contract amendments, most recently, with Harmony Healthcare IT for the Social Assistance Management System (SAMS) updates and Ombudsmanager  Programs. Ms. Haines served as the Pennsylvania Department of Public Welfare (now Human Services) first Privacy Officer and drafted and reviewed agency-wide contracts with IT providers for HIPAA Security and Privacy Compliance drafting and finalizing the initial HIPAA Privacy and Security Business Associate Agreements.
 
Sherry Philips, MSW, LCSW, SAP
Director, New Freedom Recovery Center
 
Philips has a BA and MSW from the University of Pittsburgh. She has worked in the drug and alcohol field close to 30 years, working with both adults and adolescents. Philips ran an intensive outpatient program for 13 years at Gateway Rehabilitation Center. She was the director of Wellplace in Monroeville for 8 years, and has been the director of New Freedom Recovery Center in North Huntingdon since 2015. Philips recently began a new, non-profit called Hope 4, Inc. She has also done business development for out-of-state treatment facilities, including Mt. Regis and currently Blue Ridge Mountain Recovery Center in Ball Ground, Georgia.
