LIVE WEBINAR:

Ensuring Fair Housing Compliance When Adopting a Smoke-Free Policy

HUD Recently Adopted a Rule Banning Smoking at ALL PUBLIC HOUSING SITES!
More and more multifamily properties have adopted smoking bans—both in common areas and inside apartments. And HUD has recently adopted a rule banning smoking at all public housing sites. Even some cities have proposed smoking bans in rental buildings, and courts have ruled that landlords and community associations can be held liable for residents’ injuries caused by secondhand smoke from neighboring units.

While the benefits of going smoke-free – from improving resident and employee health to saving on maintenance costs – may be clear, implementing and enforcing a ban may trigger legal challenges under the Fair Housing Act.

Speaker Lynn N. Dover will clear the air about what you can and can’t do about smoking in your community under fair housing law.

She’ll offer suggestions for preventing potential fair housing problems with respect to smoking policies and cover issues relating to residents’ use of medical marijuana in those states that have approved its use.

Topics covered will include:
  • What to include in a smoke-free policy
  • Responding to complaints about second-hand smoke
  • Responding to reasonable accommodation requests from nonsmokers
  • Considering smokers' accommodation requests
  • Addressing the use of recreational and medical marijuana
